BY VISITING OUR WEBSITE, CREATING AN ACCOUNT, LOGGING INTO, ACCESSING, OR OTHERWISE USING STOCKSIGHT, OUR WEBSITE, MOBILE APPLICATIONS, SOFTWARE, DATA, CONTENT, FEATURES, PRODUCTS, OR SERVICES (COLLECTIVELY, THE "SERVICE"), YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, ACCEPT, AND AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS ("TERMS"). StockSight is an internet-based financial research and market analysis application. The Service may allow users to search for public company information, review market data, read research summaries, analyze securities, monitor watchlists, compare companies, view analyst-related information, review financial statements and filings, and access other investment research tools.
The Service may use software, algorithms, data pipelines, models, rankings, summaries, calculations, or other automated methods (collectively, "Analytical Systems") to process information from public sources, third-party data providers, exchanges, issuers, filings, news media, analyst reports, financial websites, and other sources we deem relevant. These Analytical Systems are selected and configured by FinaSquare in its discretion and may change at any time.
The Service may include information, opinions, estimates, projections, analyst commentary, third-party content, and other materials created or supplied by third parties. FinaSquare does not control those third-party opinions or guarantee their accuracy.
You acknowledge and agree that:
1.1. The Service is provided for informational and research purposes only and is not intended for trading purposes. The Service may include information from stock exchanges, public filings, issuer materials, analyst reports, news media, financial websites, data vendors, and other sources. FinaSquare does not guarantee the sequence, accuracy, completeness, timeliness, availability, or usefulness of the Service or any information provided through it. Data may be delayed, stale, incomplete, miscalculated, unavailable, or inaccurate due to source limitations, maintenance, outages, transmission errors, parsing errors, provider errors, model errors, or other causes.
1.2. No content in the Service constitutes a solicitation, offer, opinion, recommendation, endorsement, or advice by FinaSquare to buy, sell, hold, or otherwise transact in any security, commodity, digital asset, derivative, investment product, or strategy. The Service does not provide legal, tax, accounting, financial planning, brokerage, investment advisory, or other professional services.
1.3. FinaSquare is not a registered investment adviser, broker-dealer, exchange, alternative trading system, transfer agent, custodian, bank, or trading venue. We do not execute trades, custody funds or securities, clear transactions, or provide personalized investment advice.
1.4. Any investment, transaction, trade, or other action based on information presented through the Service is made entirely at your own discretion and risk. You are solely responsible for your investment decisions and should conduct your own research and consult qualified professionals before making any investment decision.
1.5. The Service may not be intended for use by, or distribution to, any person or entity in any jurisdiction or country where such use or distribution would be contrary to law or regulation. You are responsible for ensuring that your use of the Service is lawful in your jurisdiction.
1.6. FinaSquare may use anonymized, aggregated, or non-identifiable data derived from use of the Service to operate, improve, analyze, benchmark, and develop the Service, including high-level statistics and usage trends. Any use of personal information is governed by our Privacy Policy.
1.7. FinaSquare, its officers, directors, employees, members, affiliates, agents, contractors, licensors, suppliers, successors, and assigns shall not be liable for any inaccuracies, errors, omissions, delays, interruptions, failures, loss, or damage arising from or related to the Service, including quotes, market data, rankings, summaries, financial data, filings, analyst data, calculations, charts, models, or third-party content.
2.1. Subject to these Terms, FinaSquare grants you a personal, limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Service solely for your personal, non-commercial use.
2.2. You must provide true, accurate, current, and complete information when creating an account or otherwise submitting information to us. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
2.3. You must be at least 18 years old, the age of majority in your jurisdiction, or otherwise legally able to form a binding agreement to use features that require a binding contract. We may restrict access to some content or features based on age, location, subscription status, account status, legal requirements, or other lawful reasons.
2.4. We may modify, enhance, update, or discontinue parts of the Service at any time, including through software updates, feature changes, data changes, or provider changes.
Except as expressly permitted by these Terms, you may not:
3.1. sell, license, sublicense, lease, assign, transfer, pledge, share, or otherwise make available any right granted under these Terms to any third party;
3.2. copy, transfer, distribute, scrape, crawl, harvest, cache, reproduce, republish, download, modify, create derivative works from, or commercially exploit any part of the Service, except as expressly permitted by us in writing;
3.3. use the Service for any purpose other than your own personal, non-commercial use;
3.4. frame, mirror, embed, or otherwise present the Service in another website, application, product, or service without our prior written consent;
3.5. use the Service in any jurisdiction where such use is illegal or would subject FinaSquare or its affiliates to registration, licensing, or other legal obligations;
3.6. use the Service for any unlawful, harmful, deceptive, fraudulent, abusive, offensive, or unauthorized purpose;
3.7. impersonate any person or entity, misrepresent your affiliation, or collect personally identifiable information from other users without authorization;
3.8. remove, alter, or obscure copyright, trademark, attribution, proprietary rights, data provider, or legal notices;
3.9. manipulate, distort, undermine, or interfere with the integrity, display, sequence, rankings, calculations, or accuracy of any content, data, or results in the Service;
3.10. upload, transmit, or distribute viruses, Trojan horses, worms, time bombs, spyware, malware, or other harmful code;
3.11. reverse engineer, decompile, disassemble, translate, or attempt to discover source code, data models, algorithms, ranking systems, prompts, model weights, or non-public methods used by the Service, except to the extent such restriction is prohibited by law;
3.12. bypass, probe, scan, penetrate, or attempt to circumvent any security, rate limit, access control, authentication, technical restriction, or usage limitation;
3.13. use robots, spiders, scrapers, crawlers, automated tools, browser automation, or manual bulk processes to monitor, copy, extract, train on, or collect data from the Service;
3.14. use the Service to build, train, benchmark, validate, or improve a competing product, model, data service, ranking system, research platform, or commercial database;
3.15. use the Service for commercial activity, redistribution, resale, public display, or external publication without our prior written consent;
3.16. reconfigure, reorder, combine, normalize, or repackage rankings, scores, charts, tables, data, or content from the Service for supplementary analysis, publication, redistribution, or commercial use without prior written permission; or
3.17. use the Service in any way that restricts, inhibits, damages, disrupts, or interferes with another user's use of the Service or the operation of our systems.
4.1. Some features may require a paid subscription, trial, entitlement, or other purchase.
4.2. If you purchase a subscription through Apple or another app store, billing, renewal, cancellation, refund handling, and subscription management are governed by that app store's terms, policies, and account settings. FinaSquare does not control app store refund decisions and may not be able to cancel or refund app store subscriptions on your behalf.
4.3. Monthly subscription fees are generally non-refundable unless required by applicable law or the relevant app store policy.
4.4. Access to paid features may end or change if your subscription expires, is cancelled, is refunded, cannot be verified, or if we modify, suspend, or discontinue the applicable feature.
4.5. You are responsible for reviewing your active subscriptions before purchasing to avoid duplicate purchases. Duplicate subscriptions may operate independently and may not extend, stagger, or merge access periods unless expressly stated by the app store or by us in writing.
5.1. We may modify, limit, suspend, discontinue, or terminate the Service or any part of it at any time, with or without notice. This includes software, content, data, subscriptions, Analytical Systems, rankings, tools, third-party integrations, and features.
5.2. We may suspend or terminate your account or access to the Service at any time, with or without notice, if we believe you violated these Terms, if required by law, if your use creates risk for us or others, if your subscription cannot be verified, or for any other lawful reason.
5.3. Any suspension or termination does not affect obligations that arose before termination. Provisions that by their nature should survive will survive, including ownership, disclaimers, limitations of liability, indemnification, governing law, and miscellaneous provisions.
6.1. The Service and all related content, data displays, text, posts, articles, analysis, summaries, graphs, charts, illustrations, files, images, software, scripts, graphics, photos, information, materials, products, services, URLs, technology, documentation, interactive features, designs, user interfaces, and derivative works (collectively, "Content") are owned by FinaSquare, its licensors, or third parties and are protected by intellectual property and other laws.
6.2. "Intellectual Property Rights" means all worldwide rights, whether registered or unregistered, including copyrights, trademarks, service marks, trade names, domain names, logos, trade dress, rights of publicity, goodwill, patents, patent applications, industrial designs, trade secrets, database rights, and analogous rights, including renewals, extensions, continuations, and reissues.
6.3. Nothing in these Terms grants you ownership of the Service, Content, or any Intellectual Property Rights. All rights not expressly granted are reserved.
6.4. If you submit feedback, suggestions, corrections, requests, ideas, or other input, you grant FinaSquare a perpetual, irrevocable, worldwide, royalty-free license to use, copy, modify, distribute, and otherwise exploit that feedback for any purpose without compensation or obligation to you.
7.1. We may impose limits on access to the Service, data, features, requests, page views, usage volume, storage, or other Service components at any time, with or without notice.
7.2. We may engage affiliates, contractors, vendors, data providers, cloud providers, analytics providers, payment processors, app stores, and other third parties to provide all or part of the Service. You acknowledge that such third-party involvement is acceptable.
7.3. The Service may include third-party software, data, links, content, or integrations used with permission or under applicable third-party terms. We disclaim responsibility for third-party services, content, outages, errors, policies, and terms.
7.4. Market data, financial data, analyst data, filings, news, and other third-party materials may be subject to additional restrictions imposed by their providers.
8.1. You may request deletion of your account or personal data by using available account controls in the Service or by contacting support@finasquare.com. We will process deletion requests in accordance with applicable law and our Privacy Policy. Some information may be retained where required or permitted by law, including for fraud prevention, security, accounting, legal compliance, dispute resolution, backup, and legitimate business purposes.
THE SERVICE, INCLUDING ALL SOFTWARE, ANALYTICAL SYSTEMS, DATA, INFORMATION, MATERIALS, CONTENT, CHARTS, RANKINGS, SUMMARIES, ALERTS, REPORTS, AND THIRD-PARTY CONTENT, IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, FINASQUARE DISCLAIMS ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, FITNESS FOR ANY USER'S INVESTMENT OBJECTIVES, FINANCIAL SITUATION, OR MEANS, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, QUIET ENJOYMENT, AND FREEDOM FROM VIRUSES, ERRORS, OR HARMFUL COMPONENTS.
FINASQUARE DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, TIMELY, ACCURATE, COMPLETE, OR AVAILABLE, OR THAT DEFECTS WILL BE CORRECTED. THE SERVICE MAY CONTAIN OR BE BASED ON ERRORS, INACCURACIES, MISCALCULATIONS, OUTDATED DATA, PARTIAL OR INCOMPLETE INFORMATION, OMISSIONS, MODEL ERRORS, PARSING ERRORS, SOURCE ERRORS, TRANSMISSION ERRORS, OR OTHER FAULTS.
You understand that the Service may be based on historical data, public information, third-party sources, automated processing, and assumptions that may be unreliable, incomplete, or incorrect. Past performance is not indicative of future results.
No content available through the Service constitutes a recommendation or opinion by FinaSquare with respect to any investment, security, portfolio, transaction, investment strategy, analyst, issuer, or financial product. The Service does not take into account your investment objectives, financial situation, risk tolerance, tax position, legal constraints, or specific needs.
THE SERVICE IS OFFERED SOLELY FOR INFORMATIONAL PURPOSES AND NOT FOR COMMERCIAL USE. YOU SHOULD NOT RELY ON ANY INFORMATION OR CONTENT IN THE SERVICE FOR PURPOSES OF ANY INVESTMENT OR SECURITIES TRANSACTION. YOU ARE ENCOURAGED TO CONDUCT YOUR OWN RESEARCH AND DUE DILIGENCE AND TO SEEK ADVICE FROM QUALIFIED PROFESSIONALS BEFORE MAKING ANY INVESTMENT DECISION.
TO THE FULLEST EXTENT PERMITTED BY LAW, FINASQUARE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, MEMBERS, PARENTS, PARTNERS, SUCCESSORS, AGENTS, CONTRACTORS, DISTRIBUTION PARTNERS, AFFILIATES, SUBSIDIARIES, LICENSORS, SUPPLIERS, AND RELATED COMPANIES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, PUNITIVE, OR SIMILAR DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, LOSS OF GOODWILL, TRADING LOSSES, INVESTMENT LOSSES, BUSINESS INTERRUPTION, OR COST OF SUBSTITUTE SERVICES, ARISING OUT OF OR RELATING TO THE SERVICE, THESE TERMS, OR THE PRIVACY POLICY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
YOUR SOLE REMEDY FOR DISSATISFACTION WITH THE SERVICE IS TO STOP USING THE SERVICE.
TO THE FULLEST EXTENT PERMITTED BY LAW, FINASQUARE'S TOTAL CUMULATIVE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO FINASQUARE FOR THE SERVICE DURING THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) FIFTY U.S. DOLLARS (US $50).
Any cause of action arising out of or related to the Service or these Terms must be commenced within one (1) year after the cause of action accrues, unless a shorter period is permitted by law or a longer period is required by law. Claims brought outside this period are permanently barred.
You agree to indemnify, defend, and hold harmless FinaSquare and its officers, directors, employees, members, parents, partners, successors, agents, contractors, distribution partners, affiliates, subsidiaries, licensors, suppliers, and related companies from and against any claims, liabilities, losses, damages, obligations, costs, and expenses, including reasonable attorneys' fees, arising out of or related to: (i) your access to or use of the Service; (ii) your violation of these Terms; (iii) your violation of any law or third-party right; (iv) information or content you submit; or (v) your acts or omissions.
12.1. These Terms are governed by the laws of the State of Delaware, without regard to conflict of laws principles, unless applicable law requires otherwise.
12.2. Subject to any mandatory consumer protection rules that apply to you, any claim or dispute arising out of or relating to the Service or these Terms shall be brought exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction and venue in those courts.
12.3. If a dispute arises between you and another user or a third party in connection with the Service, you agree that FinaSquare is not obligated to become involved. You release FinaSquare and its officers, directors, employees, members, parents, partners, successors, agents, affiliates, subsidiaries, and related companies from claims, demands, and damages arising out of or related to such disputes.
13.1. You acknowledge that a breach or threatened breach of these Terms may cause significant and irreparable harm to FinaSquare for which monetary damages may be inadequate. FinaSquare may seek injunctive, equitable, or other relief in any jurisdiction without posting bond, to the extent permitted by law.
13.2. No waiver of any breach or default under these Terms will be deemed a waiver of any preceding or subsequent breach or default.
13.3. Section headings are for convenience only and do not affect interpretation.
13.4. If any provision of these Terms is held unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted or severed, and the remaining provisions will remain in full force and effect.
13.5. You may not assign these Terms or any rights or obligations under them without our prior written consent. We may assign these Terms in connection with a merger, acquisition, financing, reorganization, sale of assets, or by operation of law.
13.6. These Terms, together with the Privacy Policy and any additional terms incorporated by reference, constitute the entire agreement between you and FinaSquare regarding the Service and supersede prior or contemporaneous agreements on that subject.
14.1. If the Service offers trading, brokerage, account-linking, portfolio synchronization, or financial account integrations through third-party providers, those integrations are provided as a convenience and do not constitute an endorsement, recommendation, solicitation, or advice by FinaSquare.
14.2. Any trading activity, brokerage account access, financial account access, or transaction is conducted through the applicable third-party provider and governed by that provider's terms, policies, agreements, and regulatory obligations. FinaSquare is not a party to those transactions.
14.3. FinaSquare does not act as a broker-dealer, investment adviser, financial intermediary, custodian, or clearing firm. We do not hold customer funds or securities and cannot access, modify, cancel, reverse, or guarantee execution of trades by third-party providers.
14.4. By using any such integration, you acknowledge the inherent risks of securities trading and financial account linking, including risk of financial loss, technical issues, system outages, latency, execution errors, provider errors, market volatility, and unauthorized access. FinaSquare shall not be liable for any loss, damage, expense, or claim arising from any third-party integration.
14.5. You are solely responsible for ensuring you are legally permitted and eligible to use any third-party integration and that your activity complies with applicable laws, regulations, and provider terms.
